To the attention of judges seconded without specifying a deadline for secondment to another court pursuant to paragraph 56 of Section XII “Final and Transitional Provisions” of the Law of Ukraine “On the Judiciary and the Status of Judges”

Decision of the High Council of Justice of February 18, 2025, № 264/0/15-25 amended the Procedure for Secondment of a Judge to Another Court of the Same Level and Specialization (as a Temporary Transfer), approved by Decision of the High Council of Justice of January 24, 2017,
№ 54/0/15-17.

These amendments regulate the procedure for early termination of a judge’s previous secondment pursuant to paragraph 56 of Section XII «Final and Transitional Provisions» of the Law of Ukraine “On the Judiciary and the Status of Judges” (without specifying a deadline for the secondment) and his/her simultaneous secondment.

In order to exercise its powers under this procedure, the High Qualification Commission of Judges of Ukraine adopted a decision on February 26, 2025, according to which a list of 100 local general courts, 5 local administrative courts and 5 local commercial courts with the highest level of excessive judicial workload or where it is impossible to administer justice was formed.  This decision also approved the form of application for early termination of a judge’s previous secondment and simultaneous secondment.

In order for the Commission to consider the issue of establishing the existence of grounds for early termination of the previous secondment of a judge and his/her simultaneous secondment, we suggest that judges submit an application in accordance with the approved form (in Ukrainian) by March 10, 2025 (inclusive).

The application with a qualified electronic signature must be sent to the Commission’s  
e-mail (inbox@vkksu.gov.ua).

When deciding on the early termination of a judge’s previous secondment and simultaneous secondment, the Commission will take into account the judge’s consent to be seconded to a court from among the courts with the highest level of excessive court workload or where it is impossible to administer justice.

Please be informed that the Commission has published a list of local courts with the highest level of excessive court workload or where it is impossible to administer justice, which can be found in the «Documents» section of the «Judges’ Secondments» subsection of the «Activities» section of the Commission’s official website or at this link (in Ukrainian).

In addition, please be informed that after March 10, 2025, the Commission will exercise the authority to establish the existence of grounds for early termination of the previous secondment of judges pursuant to paragraph 56 of Section XII «Final and Transitional Provisions» of the Law of Ukraine “On the Judiciary and the Status of Judges” and their simultaneous secondment, including judges who have not submitted the above application.
